Terms of Service

1. Acceptance of Terms

By accessing or using the PixelQuick platform (“Service”), operated by Synthia Labs HK Limited (“Company,” “we,” “us,” or “our”), a company incorporated in Hong Kong, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time, and continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By creating an account, you represent and warrant that the information you provide is accurate, complete, and current, and that you have the legal capacity to enter into a binding agreement.

3. Account Registration

To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Billing

The Service operates on a pay-as-you-go credit system. One credit entitles you to one creative generation. Credits are sold in the following packages:

• Mini — 3 credits for $4.00 USD
• Small — 6 credits for $7.89 USD
• Medium — 17 credits for $15.69 USD
• Large — 29 credits for $23.39 USD
• Pro — 58 credits for $38.99 USD
• Unlimited — 265 credits for $155.99 USD

All prices are in US Dollars. Applicable taxes may be added at checkout. Credits do not expire but are non-transferable between accounts. We reserve the right to modify pricing with reasonable notice. See our Refund Policy for details on refund eligibility.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Create non-consensual intimate imagery of real individuals
• Infringe upon the intellectual property rights of any third party
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service in a manner that exceeds reasonable use or circumvents rate limits
• Distribute malware, viruses, or other harmful computer code through the Service

We reserve the right to remove content and suspend accounts that violate these restrictions without prior notice.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and the underlying technology — are the exclusive property of Synthia Labs HK Limited and are protected by international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, you retain ownership of the creative outputs you generate using your purchased credits. Each generation includes a perpetual, worldwide, non-exclusive commercial licence for the output. You may not, however, claim that outputs were created without the use of computational tools, nor register outputs as trademarks in a manner that would restrict others from generating similar results.

7. User Content

You may upload reference images, text descriptions, and other materials (“User Content”) to the Service. You retain all rights to your User Content. By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to process and transform it solely for the purpose of providing the Service to you.

8. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us at hello@pixelquick.org with a detailed description of the alleged infringement, including identification of the copyrighted work and the infringing material.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYNTHIA LABS HK LIMITED AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Synthia Labs HK Limited and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any unused credits at the time of termination for cause are forfeited. Sections that by their nature should survive termination shall survive, including Sections 6, 10, 11, 12, and 14.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”), without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Hong Kong. Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@pixelquick.org.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Synthia Labs HK Limited regarding the Service and supersede all prior agreements and understandings, whether written or oral.
